This calculator helps you estimate how much you could be owed in a severance package, taking into account your salary, time worked, proportional benefits, pending vacation, and, when applicable, indemnity.
The result is indicative and does not replace a legal review. In Guatemala, severance pay does not apply in all cases; it generally corresponds to unjustified dismissal or other legally applicable scenarios.

Severance pay normally applies in wrongful termination or under the causes set forth in Article 79 of the Labor Code. In resignation, justified termination, or during the probation period, severance is generally not calculated.
Recommendation: enter the base salary without the Q250 incentive bonus. If you entered a salary that includes it, select “Yes” to subtract it automatically.
What to put here: Enter the average monthly accrued amount over the last 6 months when there are commissions, variable salary, recurring overtime, or other payments that must be included in the calculation base. If the salary has been fixed, you can leave it blank and the ordinary monthly salary will be used.
The automatic option estimates 15 days per year in proportion to the time worked. If you already know the actual pending days, use the manual mode.
Use this “Other pending payments” field to add pending labor amounts that are not automatically calculated. For example: pending commissions, recognized overtime, unpaid bonuses, balances of aguinaldo or Bono 14 from previous periods, worked days not included, per diems recognized as pending payment, or other agreed-upon amounts.
Use this field exclusively for documented advances or adjustments. The calculator subtracts the entered amount, but does not determine whether the deduction is legally permissible; that validity must be reviewed based on the documents and the specific case.

What does this tool calculate?
The tool estimates the main categories that are usually reviewed at the end of an employment relationship in Guatemala. It takes as a reference the Labor Code and specific laws regarding benefits such as the Christmas Bonus (Aguinaldo) and Bonus 14.

It is calculated when applicable, usually due to unjustified dismissal or causes attributable to the employer. The basis uses the salary average and a proportional integration of the Christmas bonus (aguinaldo) and Bono 14 to estimate the severance base.

- Compensation: Article 82 of the Labor Code: one month's salary for each year of continuous service, or a proportional amount if the time is less.
- Average salary: Article 82 states that the severance pay is calculated based on the average wages earned during the last six months, or the time worked if it was less.
- Basis of compensation criterion: This calculator uses a broad base that proportionally integrates the average salary, aguinaldo, and Bono 14 to estimate severance pay when applicable.
- Vacation: Article 130 of the Labor Code: a minimum of fifteen business days of vacation after each year of continuous work; Article 131 requires a minimum of 150 days worked to acquire the annual right.
- Bonus 14: Decree 42-92: it is equivalent to one ordinary salary per year and is paid proportionally if the employment relationship ends before completing the period.
- Christmas bonus Decree 76-78: it is equivalent to an annual salary and must be calculated proportionally when the employment relationship ends.
