Occupational Health and Safety Practices for Work in Guatemala

In today's world, it is undeniable that human capital is one of the most valuable assets of any organization.

This is why, as an employer, you must ensure compliance with occupational health and safety regulations. By avoiding the spread of diseases and ensuring the prevention of Workplace accidents and occupational diseases.

In this context, Government Agreement 229-2014, Occupational Health and Safety Regulations, establishes a series of employer obligations whose main objective is Protect the life, health, and safety of workers.

Said regulation contemplates a series of rules that regulate structural and environmental aspects that all employers must observe and apply in the workplace.

On the other hand, it establishes a series of mechanisms for verification and compliance with said regulations, which are the following:

Internal verification mechanisms

  • Health service provision: Employers are obligated to grant Occupational health services, whose nature and scope vary depending on the number of workers. Said services must be provided by a monitor, nursing assistant, registered nurse, or active licensed physician, as appropriate.
  • Occupational Safety and Health Organization Establish an organization Occupational health and safety regulations verification and compliance. Depending on the number of workers, the company may designate a monitor or, in any event, facilitate the creation of a Bipartite Occupational Health and Safety Committee, who will be in charge of said task.
  • Having an occupational health and safety plan or a work-related risks plan: every employer has the obligation to have a plan that provides support for the risk management, its scope and formalization process will depend on the number of employees in the organization.

2. External verification mechanisms:

The law empowers both Labor and Social Welfare Inspectors and Inspectors from the Guatemalan Social Security Institute to verify compliance with Occupational Health and Safety regulations.

The fulfillment of the aforementioned regulation generates a healthy environment which in turn increases the productivity of companies. Therefore, it is recommended that they be supervised at all times.

In addition to the above, avoid the imposition of fines by the corresponding administrative entity, which can range from eight to sixteen minimum wages.
